Would you like something to eat? A little crow maybe? Some humble pie?
Though Elizabeth Jennings (a force of nature at 60) spent the bulk of her law career as a corporate counsel, when she changed sides and became a plaintiffs counsel she did it with a vengeance. Elizabeth and her small law office are about to go to trial representing a breach of contract case against a large, powerful, multi-national bank called Rhinebank.In 1913, Armenian composer and priest Solomon Solomonyan (St. Komitas) opened a bank account with Rhinebank. He named his common law wife, Salome and their young son Harut (Harry), as his beneficiaries. But then the First World happened and, in 1915, the Armenian Genocide. Though Komitas survived the war, Salome died in the Genocide. Her death and the death of so many innocent Armenians drove Komitas to madness.Elizabeth represents Steve Solomon Harrys son. Though the case is essentially about getting Rhinebank to return the money deposited by Komitas, Elizabeth and Steve want to put Rhinebank itself on trial for its role in the Genocide: it financed the railway line (that was being constructed between Berlin and Baghdad) that was the rationale for the Ottoman Turks to uproot and murder its Armenian population.On the day the story begins with the trial nine days away from starting Rhinebank quietly goes on the offensive to try and wipe out the principal piece of evidence against them: the actual bank documents that prove the bank account ever existed (and all copies of the documents hard and electronic).They also hire a group of mercenaries to kill all the members of a Turkish trade office in New York City leaving evidence behind that implicates an Armenian organization; Rhinebanks goal to poison the potential jury pool should Elizabeth continue to press forward with the trial.Finally, the bank sends another group of mercenaries to confront Steve Solomon to force him to turn over the original bank documents (they were stolen by Harry Solomon from the main Rhinebank office as the Russians invaded Berlin during WW2). The mercenaries are surprised when Steve Solomon a cantankerous, paranoid, driven man chooses to blow himself (and the mercenaries) up rather than comply.Suddenly Elizabeth finds herself (and her case) in a deep hole. She has no complainant. She has no files proving her case (and shes been severely restricted by the court on what evidence she can present. Calling her staff together, she finds them depressed and ready to quit the case. But Elizabeth believes in the larger purpose to put the bank on trial and put the Armenian Genocide (seemingly forgotten by history) front and center in the worlds attention.Elizabeth sends Peter the young lawyer who works for her to Yeravan to retrieve Sally Solomon, Steves daughter (hoping that shell step forward and take up the cause). Peter is reluctant (hes as unlawyer-like as a person can be). But he also fears that their case has now been totally and irreparably compromised.Meanwhile, Elizabeth goes to JUDGE HARRISON COOPER wholl be overseeing the trial to make him aware of all the underhanded, deceitful things (she believes) Rhinebank has just done. Because Elizabeth cannot prove any of it (that Rhinebank had any involvement), he dismisses her concerns.Undaunted, Elizabeth goes to her opposite number the man wholl be representing the bank THELONIUS HICKS; he used to work as Elizabeths second in command back when she was a corporate lawyer. Though Elizabeth feels certain that Thelonius is unaware of his clients connection to the terrible acts that have been carried out, she tries to warn him: his client is guilty of these acts and she has no intention of backing down shes even more committed to putting the bank on trial for their terrible, inhuman and murderous behavior.Meanwhile, Peter has met up with Sally in Yerevan and given her the bad news. As he escorts her back to New York, Sally takes a dislike to Peter she doesnt like lawyers much to begin with and has no interest whatsoever in joining the case. Sally, we learn, had been estranged from her father for years; from the time she was very young, Steves idea of parenting was to shove the past in her face to make her feel the same sense of responsibility for it that he felt. Though Sally remains interested in Armenian music, she feels no connection to or sense of obligation regarding the Genocide.As Peter and Sally continue on their flight to New York, a mysterious meeting takes place between CARTER ACHESON, the CEO of Rhinebank, and a man named WALTER FLESCH. Acheson and Flesch had been brothers in arms many years before, serving as mercenaries in Africa. Flesch now runs a small black ops security company. The company has been working for Acheson. Knowing that Elizabeth still intends to go to trial, Acheson tells Flesch to do whatever it takes to make sure that the trial never happens.Back at the law office, Peter and Elizabeth tell Sally that Peter will accompany Sally to Fresno to help her with any legal hassles she might face as she deals with her fathers death. Sally reluctantly agrees to it.As Peter and Sally fly off to California, Elizabeth meets with her document expert where she is reassured that their electronic copy of the documents (provided Elizabeth still has a copy she doesnt) will stand up at trial though the better alternative would be to present the originals. Leaving the document experts apartment in the East Village, Elizabeth realizes shes being followed by Uli, Frans and Horst the three mercenaries who shot up the Turkish trade office. Discovering that her cell phone has been blocked from making calls, Elizabeth runs trying to get help.As Uli, Frans and Horst close in on Elizabeth, she spots a policeman approaching. She races to him and, as she pleads for help the POLICEMAN STABS HER WITH A POISONED NEEDLE. The Policeman is Walter Flesch.Arriving in Fresno, Peter learns the bad news about Elizabeth. Hes crushed and intends after catching a few hours of sleep to fly back to New York.At the Fresno police station, Sally bumps into MICHAEL HARTUNIAN an old high school friend (and former marine) whos now a cop with the Fresno PD; Michael also had been working a second job for Steve installing security systems.Peter and Sally go to a nearby motel (so Peter can catch some sleep before flying home). There Sally learns that there may be more to Peter than she thought. Peter, it turns out, also is an accomplished musician. As he deftly plays the mandolin that Sally brought with her from Yerevan, Michael Hartunian arrives and arrests Sally.At the Fresno police department, Sally learns that the FBI wants to question her about the Armenian terrorist attack on the Turkish trade office. Sallys name has turned up on an FBI bulletin.Fearing that the whole thing is a set-up meant to harm Sally, Peter, in a moment of brash desperation (hes seen the three FBI agents whove arrived to question Sally and suspects they arent who they say; they are in fact Uli, Horst and Frans), takes Michaels gun and helps Sally escape.Now on the run, Sally directs Peter to the home of GREGORY an old family friend and Sallys former music teacher. Gregory puts them both up, feeds them and gives them a chance to catch their breath. As he has all along, Peter updates his office with whats happening to them, sharing information with and getting helpful information from the offices receptionist, NORA.Realizing now just how desperate the bank is to keep its secrets hidden, Sally is a little more inclined to help Peter find the original bank documents he needs at the trial (though she still doesnt want to be part of the trial). She and Peter begin to discuss the history of the documents and how they got into Steve Solomons hands in the first place which we learn by moving backward through the chronology.(We learn that a few years ago, Elizabeth represented the insurance company with which Komitas had a life insurance policy which named Seda, Sallys great-grandmother, as the beneficiary. Before the case went to trial though, Elizabeth experienced her change of heart regarding the corporate world; the insurance company settled with Steve and that money is what hes used to try and sue Rhinebank. We also learn that when Elizabeth started working with Steve a frustrating prospect because of Steves personality and bullheadedness he refused to give Elizabeth the original bank documents or even tell her where he was hiding them; instead, Steve sang a song about an apricot tree).The next morning, using Gregorys car, Peter and Sally go to the nursing home where her 106 year old grandfather (Harry Solomon) now lives. Sally thinks that her fathers reference to the apricot tree was his (annoying) way of hinting to Elizabeth to go ask Harry about the documents; the ward of the facility where Harry lives is called Apricot.Unbeknownst to Peter and Sally (as they head to Harrys facility), theyre being followed by Michael who has tracked them to Gregorys house.Peter and Sally find Harry going in and out of consciousness vaguely aware of their presence, vaguely aware of who Sally is. Looking around the room, Peter finds the key to a safety deposit box. They ask Harry about it. For a moment he seems to understand them but then begins pounding on his chest (as he mumbles something in Armenian). Peter and Sally think hes ranting until Sally remembers: her grandfather has a tattoo on his chest of Mount Ararat.The key, it turns out, will fit a safety deposit bank at a bank that used to be called Ararat Bank and Trust; its in downtown Fresno. As they head there, Peter updates Nora about what theyre doing.Meanwhile, Walter Flesch has met again with Acheson. The stakes are even higher than before. History, says Acheson, Is a contact sport. Flesch promises Acheson that he and his men will accomplish their mission. Flesch boards a private jet heading west.Meanwhile, in Fresno, as Peter and Sally continue on their way to the bank, we learn more of the back story: Steve Solomon has always been much more activist than his father Harry. Even as a kid when Harry went to visit famed Armenian-American author (and Fresno resident) William Saroyan, Steve could not understand why these men didnt want to seek immediate justice for the Genocide. We learn how the documents came into Harrys possession; he fought for the Russian Army during the war and, as Harrys unit was invading Berlin, he split off and broke into the Rhinebank offices to try and find his fathers bank records. Finding them, Harry went to celebrate with some fellow Armenians when a sniper bullet hit him. Ending up in an American hospital, Harry met the nurse who would become his wife (and Steves mother).We return to the present; Peter and Sally have reached the bank (they park Gregorys car in the parking structure next door). Peter realizes as they enter the bank however that he and Sally have been tracked there by Uli, Horst and Frans.Sally goes in to the safe deposit vault where, in her grandfathers box, she finds a thick binder filled with documents. She puts them in her bag and rejoins Peter in the bank.Peter (who fears theyll be grabbed the moment they walk out of the bank) hurriedly leads Sally toward a back elevator. They try to get back to their car via one of the upper level bridges that connects the building to the parking structure.In the parking structure, they get chased by the three mercenaries only to be rescued by Michael. Michael, it turns out, has been watching their back having become aware that Sally was in genuine danger at the police station.Michael, Peter and Sally escape the mercenaries only to be chased by them out into the desert where their car flips over. Peter and Sally manage to get out of the car but Michael is trapped.As Sally and Peter try to get away, the mercenaries surround them. Theyre about to take Sally and Peter prisoner when Michael having freed himself and found his service revolver shoots the mercenaries, killing them.Finally having a moment to look at the documents they got from the safety deposit box, Sally sees that it isnt the bank documents but rather an old book manuscript autographed by William Saroyan. Though initially crushed by the discovery, Sally thinks maybe she misunderstood the clue her father sang to Elizabeth. She directs Michael to drive them to the Saroyan museum located just outside of town.The Saroyan Museum, as a possible hiding place, makes sense to Michael; he had helped Steve install a security system there complete with multiple cameras and a back-door to the system that would allow Steve to both access the Museum grounds and the video feed from the Museums security cameras.Arriving as night falls (and the Museum staff go home), Sally realizes both where her father hid the bank documents (and what he was referring to in his song): Off to the side of the main structure is a row of apricot trees. Michael and Peter (borrowing shovels from a tool shed) begin to dig hurriedly.As Sally updates Nora back in the law office, Michael and Peter find an old pottery container with a plastic-wrapped sheaf of bank documents inside. Michael and Peter begin to climb from the hole and discover that Walter Flesch has arrived. He holds one hand over Sallys mouth; in the other hand he holds a gun.Flesch takes Sally and the bank documents and (telling Michael and Peter that hell kill Sally if they try to follow him) heads for his car. Flesch makes Sally drive. Sally tries to talk Flesch out of destroying the documents. Flesch will not be dissuaded. History, he tells her (repeating what Acheson told him), Is a contact sport.He directs her toward a large trash burning facility on the far outskirts of Fresno.There, Flesch throws the bank documents into the facilitys incinerator. Sally feeling the tug of heroism as never before in her life dives in to try and save the documents. Fearing that Sally will escape with them, Flesch dives in after her. He manages to take the documents from Sally but ends up getting pulled into the incinerators furnace where both he and the documents are burned to a crisp.Sally escapes happy to be alive but miserable that she lost the main piece of evidence supporting the case. Peter assures her that hell think of something to make up for the loss.You better, says Sally. She tells Peter that she has decided to become the complainant in the trial. She has picked up the mantle. Still, Peter doesnt want to get Sallys hopes up. The odds are still totally against them.Sally and Peter return to New York, the trial now only a few days away. There, Peter tries to reassure the staff at the law office that they can win. How exactly (without any evidence to present) he isnt sure yet As he sends the staff off to get to work, Nora (the receptionist) approaches Peter. She confesses that all along (due to blackmail), she has been supplying people working for the bank (Flesch) with inside information about Peter and Sally, where they were, and the case in general.Nora quits deeply apologetic. Peter realizes: theyve been undone almost from the very beginning.A few days later, jury selection begins. Afterward, Peter is approached by Thelonius the lawyer representing the bank. Thelonius asks if Peters client would be open to a settlement. Peter realizes too late that his interest in a deal has just signaled to Thelonius that he (Peter) has very little to work with and very little expectation of winning.That night with the trial itself about to begin Peter and Sally commiserate over dinner. Afterward, Sally invites Peter back to her hotel room. They make love. Afterward, Sally goes to put on some music (on her notepad computer) and discovers a batch of unopened email waiting for her. It suddenly occurs to Sally that among all her unopened email are emails sent her by her father.The next morning, the trial begins. Peter seems hopelessly outclassed by Thelonius. As Peter stumbles through his opening statement, we go even further back in time to Komitas raving mad, sitting in his cell at an insane asylum in Paris and then to the Genocide itself.We see Komitas and his family taken from their apartment the stream of Armenians wrenched from their lives and put onto to trains or forcibly marched away from their homes. Some are shot outright. Others succumb to starvation and exhaustion. The brutality of the Turkish soldiers is extreme, heartless. No one is immune from their cruelty.Komitas and his family have reached the Syrian desert when a group of officers drive up. The Turkish high command has decided to send Komitas back to Constantinople. Seda, his wife, tries to intercede. The Turkish soldiers beat her with the butts of their rifles killing her as Komitas tries to resist and as young Harut watches in horror. We cut from young Harrys eyes back toSallys eyes as she watches Thelonius finish his opening statement. While something terrible did perhaps occur all those years ago, he allows, it has nothing whatsoever to do with the bank account the trial is really about. The case, he says, is very simple.Peter calls his first witness Carter Acheson, the banks CEO. Peter seems to be trying despite the judges stern admonishment to put the bank on trial as Elizabeth had wanted to do. As Peters tack is constantly blocked by the Judge, even Sally seems to be wondering what the hell Peter is up to.Peter badgers Acheson if he remembered seeing the document that proved that the account in question even existed. Acheson says he doesnt remember the particular document. Peter pushes the issue again getting rebuked by the Judge; the Judge threatens Peter with contempt.Peter faces Acheson. Asks him if he believes that history is a contact sport?Acheson is momentarily taken back. Peter presses on suddenly introducing his first piece of evidence an electronic copy of the bank records in question. Acheson is stunned. He knows in that instance that he will not only lose this trial but all the trials to come. Peter has set him up.In the corridor outside the courtroom a few minutes later, Thelonius approaches Peter to see if Peter still has any desire to settle with the bank. The look on Peters face tells us: Sure Peter and Sally will settle but the cost to the bank is going to be enormous.A few days later Peter and Sally have returned to Fresno, to see Harry.
